Massachusetts security deposit deadline

In Massachusetts, a landlord generally has 30 days after move-out to return your deposit or send a written itemized statement of deductions. The governing law is M.G.L. c. 186, § 15B.

What can happen if the landlord doesn’t comply

Under M.G.L. c. 186, § 15B, a landlord who fails to return the deposit, with interest, within the deadline forfeits the right to retain any portion of it and may be liable for three times the amount of the deposit to which the tenant is entitled, plus 5% interest, court costs, and reasonable attorney’s fees.

Steps to get your deposit back

  1. Note your move-out date and check the deadline above.
  2. Send a written demand by certified mail with return receipt, and keep a copy.
  3. Include photos, your lease, and any move-out inspection report.
  4. If the landlord doesn’t respond, small claims court is the usual next step.
