Virginia security deposit deadline

In Virginia, a landlord generally has 45 days after move-out to return your deposit or send a written itemized statement of deductions. The governing law is Va. Code § 55.1-1226.

What can happen if the landlord doesn’t comply

Under Va. Code § 55.1-1226, if a landlord willfully fails to comply, the court shall order the deposit returned to the tenant together with actual damages and reasonable attorney’s fees.

Virginia: the landlord may extend to 60 days only if it gave written notice within the 45 days that third-party repairs exceed the deposit.

Steps to get your deposit back

  1. Note your move-out date and check the deadline above.
  2. Send a written demand by certified mail with return receipt, and keep a copy.
  3. Include photos, your lease, and any move-out inspection report.
  4. If the landlord doesn’t respond, small claims court is the usual next step.
