New York security deposit deadline

In New York, a landlord generally has 14 days after move-out to return your deposit or send a written itemized statement of deductions. The governing law is New York General Obligations Law § 7-108(1-a).

What can happen if the landlord doesn’t comply

Under New York General Obligations Law § 7-108(1-a), a landlord who fails to return the deposit or provide an itemized statement within the deadline forfeits any right to retain any portion of it, and a willful violation may result in punitive damages of up to twice the deposit.

New York: this applies to non-rent-stabilized apartments.

Steps to get your deposit back

  1. Note your move-out date and check the deadline above.
  2. Send a written demand by certified mail with return receipt, and keep a copy.
  3. Include photos, your lease, and any move-out inspection report.
  4. If the landlord doesn’t respond, small claims court is the usual next step.
